How the tip credit works

In most states, employers can pay tipped workers less than the minimum wage, down to the tipped cash wage, and count your tips towards the rest. If your wages plus tips for the workweek come to less than the minimum wage for all the hours you worked, your employer has to pay the difference.

What is the tip credit?
The part of the minimum wage an employer covers with your tips. Under federal law they can pay you as little as $2.13 an hour and count up to $5.12 of tips towards the $7.25 minimum. Many states set a higher cash wage.
Is it checked per shift or per week?
Under federal law, per workweek: wages plus tips for the week have to reach the minimum wage for every hour you worked that week.
Which states don’t allow a tip credit?
Alaska, California, Minnesota, Montana, Nevada, Oregon and Washington. There, you get the full minimum wage before tips.
Can my employer keep part of my tips?
No. Under federal law, employers, managers and supervisors can’t keep workers’ tips. A tip pool shared among tipped workers is allowed.
